It is important to get the terms and conditions of your employment
in writing. This will ensure that you and your employer will
know what is expected of each other. If it is signed, it can
also be enforced in a court of law. The contract, or agreement
should include the following:
- The hours and wages per hour. (It should also include the
work schedule.)
- Holidays and vacation time.
- Personal days and sick time.
- Health benefits.
- Length of the employment (it should also tell how much notice
must be given to terminate the contract).
Keep all your records in a safe place. Do not give them to
your employer to keep for you. If your employer insists on keeping
them, give him/her a photocopy but not the original.
Safety measures
Make sure that others know where you work. If you have a bank
account, you should be the only one to have access to it. Make
sure that you receive your wages directly. You should make the
deposits to the bank and not your employer (except in the case
of direct deposits)
Your pay
Your employer may deduct certain costs — but only these
described below as required by law —such as Social Security
and income tax. Those which you consent to in writing such as
health insurance premiums, pension payments and union dues.
If your employer provides you with meals and a place to stay
– he/ she can only deduct :
- $ 1.75 for each meal
- $2.20 per day for accommodation
- $4.10 per day for an apartment with utilities.
Your employer MAY NOT:
- Deduct money if you broke or spoiled something accidental
ly
- Deduct travel expenses if you are traveling with your employer
- Deduct insurance premiums for workers compensation or unemployment
benefits.
Payment in cash under the table?
This can be a disadvantage to you. It makes it easier for the
employer to avoid paying worker’s compensation, unemployment
insurance and social security which means that it makes it harder
for you to prove your eligibility for benefits. (While workers
compensation is available to all workers regardless of immigration
status, you must be work authorized to receive unemployment
insurance and social security.)
If you work at employer parties or functions
Your employer cannot demand or accept directly, indirectly
any part of the tips received by an employee. If you were given
tips, your employer is still required to pay you the minimum
wage and overtime.
Note: The wages mentioned above are an average
weekly wage for a 40-hour work week.
